DISTANCE SELLING AGREEMENT

ARTICLE 1 - PARTIES

ARTICLE 2 - SUBJECT The subject of this agreement is to determine the rights and obligations of the parties regarding the sale and delivery of the products ordered by the Buyer via [www.smindstudio.com], in accordance with the provisions of the Turkish Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts. By placing an order, the Buyer is deemed to have accepted all terms of use, the basic characteristics of the products, the sales price, and the payment methods specified on the Seller's website.

ARTICLE 4 - PAYMENT AND DELIVERY TERMS

  • Payments can be made via credit card, debit card, or wire transfer/EFT.

  • Orders placed on weekdays before 12:00 PM (TRT) will be dispatched within 4 business days. Orders placed after 12:00 PM will be dispatched within 5 business days.

  • The shipping fee varies depending on the cart total and the destination country, and it is clearly displayed to the Buyer at checkout.

ARTICLE 5 - RIGHT OF WITHDRAWAL & RETURN POLICY

  • For International Orders: Please note that we do not accept returns or exchanges for international orders. However, customer satisfaction is our top priority. If you experience any issues, dissatisfaction, or receive a damaged item, please contact us immediately. We will do our absolute best to assist you and find a fair solution.

  • For Domestic Orders (Within Turkey Only):

    • The Buyer has the right to withdraw from the contract and return the product within 14 days of receipt. To exercise this right, the Buyer must notify the Seller in writing or via email.

    • To be eligible for a return, the product must be undamaged, unused, and in its original packaging.

    • Once the withdrawal notice is provided, the product must be shipped back to the Seller within 10 days.

    • The return shipping costs belong to the Buyer. However, if the product is defective or incorrect, the return shipping costs will be covered by the Seller.

ARTICLE 6 - DELIVERY AND SHIPPING

  • The Seller is obligated to hand over the ordered products to the shipping carrier within 1 to 5 business days.

  • Products are delivered to the address specified by the Buyer. If the Buyer is not present at the address during delivery, the package may need to be picked up from the local branch of the shipping carrier, depending on local carrier policies.

  • The Buyer must inspect the package during delivery. Damaged or opened packages must not be accepted, and the Buyer must request a damage report (tutanak) from the delivery personnel.

ARTICLE 7 - FORCE MAJEURE Events that develop outside the control of the parties and prevent them from fulfilling their obligations (such as natural disasters, war, terrorism, pandemics, customs delays, etc.) are considered force majeure. The parties cannot be held liable for delayed or unfulfilled obligations during the period of force majeure.

ARTICLE 8 - PRIVACY AND SECURITY Personal information provided by the Buyer through the website will be kept strictly confidential by the Seller and will not be shared with third parties, except as required for order fulfillment (e.g., sharing address with the shipping company).

ARTICLE 9 - DISPUTE RESOLUTION In the event of any dispute regarding domestic transactions, the Buyer may apply to the Consumer Arbitration Committees or Consumer Courts located in the Buyer's or Seller's place of residence, within the monetary limits declared annually by the Turkish Ministry of Trade.

ARTICLE 10 - EFFECTIVENESS The Buyer declares that they have read, understood, and accepted this agreement before placing an order on the website. The completion of the order implies the full acceptance of this agreement.
